I find it completely unbearable, that Captain Mark Kelly was a member of the branch of military in which I served - The United States Navy. And as a former 04, I can scarcely grasp the instructions of a retired 06 to the troops who still wear the cloth of our nation. Disobey orders. He added the "il" to legal.

He knows how orders are generated. I know how orders are generated. In my branch, Navy Admin hands off your orders. Your orders will contain several salient features:

You will receive these orders with the understanding that the Secretary of the Navy has access to your orders and the command duty station will also have a copy of your orders on the quarterdeck. They know you are coming. You are expected to be on time and in uniform. Otherwise, you are M.I.A. and will be charged with dereliction of duty.
There have been times when I changed into the uniform of the day in the airport bathroom prior to securing transportation to my next destination. This is what real soldiers do. On arrival to the quarterdeck, the log is annotated regarding your arrival and you will receive directions to base housing, unless housed elsewhere. You will be instructed regarding reporting to chain of command and who is your immediate superior. They are your boss. Deserving of respect and your best salute.
If part of a larger contingency of soldiers (such as the group I was with for cold weather training at Fort McCoy in Wisconsin) even the galley cooks are aware of your arrival. They need to bump up the number of eggs in the refrigerated spaces, dairy, protein, starch, and fresh selections. All things work together for the good of the soldier. In return, the fidelity of the oath keeper is required.
If headed to D.C., or perhaps Guam (I have been on orders to both locations) the per diem can be generous. So you have your orders, you have a per diem, you are going to work your ass off and you will do it because you love our nation.
Every soldier in uniform who has been deployed CONUS (inside the Continental United States) have orders in hand, are under an identifiable chain of command, and are legally engaged in the work of our Republic. Those not on orders, are not allowed within our ranks.
Court martial is too good for Captain Mark Kelly. He should be called back to active duty under extenuating circumstances and receive a set of standard orders no differently than the two National Guardsman who were killed today. His orders should place him remote and not near his family. Hopefully, his orders are to clean latrines for six months. And then his orders should be followed with a court martial under Article 133 of the UCMJ.
He did not pull the trigger today. But he loaded the gun.
* News is in flux: Now it is reported the soldiers are still alive. Regardless, with a report of one shot in the head, there may be legal brain death with the need for evoked potentials to confirm brain death. Nothing changes regarding my personal animus against Captain Mark Kelly, USNR.
